About the eviivo/efsta Integration 

If your business operates in France and is required to comply with NF525 fiscal regulations, eviivo offers an integration with efsta to help you meet these requirements. 

The integration works in the background, securely sending eligible sales transaction data from eviivo to efsta for fiscalisation in accordance with French legislation. This allows you to continue using eviivo to manage your business while supporting your compliance obligations. 

Before you enable the integration, please take a moment to read the terms below. They explain how the service works, what data is shared with efsta, and the responsibilities of eviivo, efsta, and your business when using the integration. 

EFSTA Cloud Fiscal Service Terms (addendum for eviivo Customers) 

1. Purpose 

These terms apply where an eviivo customer subscribes to the EFSTA Cloud Fiscal Service through the eviivo Suite PMS. By activating the service, the Customer agrees to these terms in addition to their existing eviivo Suite subscription General Terms and Conditions provided by EFSTA 

The EFSTA Cloud Fiscal Service enables the fiscalisation, storage and transmission of fiscal transaction data in accordance with applicable fiscal legislation. The service is provided through eviivo using technology supplied by EFSTA. 

2. Service Provision 

eviivo provides a streamlined onboarding process to the EFSTA Cloud Fiscal Service through an API integration. The fiscal service itself is fully delivered, operated, and supported by EFSTA, while eviivo acts solely as the integration and enrollment facilitator.  

Fiscal processing, cloud infrastructure and regulatory functionality are operated by EFSTA. 

eviivo is responsible for the integration of the service into eviivo Suite. EFSTA is responsible for the operation of its cloud platform and fiscal services. 

3. Customer Responsibilities 

The Customer agrees to: 

  • provide accurate business information, including legal entity details and VAT registration information; 
  • use the service only for lawful business purposes; 
  • ensure that users authorised to access the system maintain the confidentiality of their login credentials; 
  • notify eviivo promptly of any suspected unauthorised access; 
  • maintain internet connectivity required for the operation of the cloud fiscal service; 
  • comply with all applicable tax and accounting obligations. 

The Customer remains solely responsible for the accuracy of sales transactions entered into eviivo Suite. 

4. Fiscal Records 

The Customer acknowledges that fiscal records generated through EFSTA form part of its statutory accounting records. 

The Customer is responsible for retaining any additional accounting records required under applicable legislation. 

The Customer should not attempt to modify or interfere with fiscal records generated by the service. 

5. Availability 

eviivo and EFSTA will use commercially reasonable efforts to maintain service availability. 

Temporary interruptions may occur due to: 

  • scheduled maintenance; 
  • software updates; 
  • telecommunications failures; 
  • force majeure events; 
  • failures of third-party infrastructure. 

Neither eviivo nor EFSTA guarantees uninterrupted or error-free operation. 

6. Data Processing 

Transaction data processed through the fiscal service may include invoice information, payment information, user identifiers and technical system information necessary to operate the service. 

The Customer authorises the processing and storage of such information for fiscal compliance, audit, security and regulatory purposes. 

Personal data will be processed in accordance with applicable data protection legislation and the eviivo Privacy Policy. 

7. Third-Party Service 

The Customer acknowledges that fiscal services are powered by EFSTA. 

Certain functionality depends upon EFSTA’s cloud platform and related infrastructure. 

If EFSTA permanently withdraws or materially changes the underlying service, eviivo may replace the fiscal service with an equivalent solution where reasonably practicable. 

8. Fees 

The eviivo Customer agrees to pay all subscription fees applicable to the EFSTA Cloud Fiscal Service, which is required to ensure compliance with French fiscal regulations (NF525).  

The standard EFSTA France package is billed at €100 per cash register per year, including secure fiscal archiving and up to 60,000 transactions annually per cash register. Registration and activation are simplified through the eviivo platform, while the fiscal service itself is fully operated and maintained by EFSTA. 

Failure to pay applicable fees may result in suspension of the fiscal service by Efsta. 

9. Suspension 

eviivo may suspend the fiscal service where: 

  • subscription fees remain unpaid; 
  • fraudulent or unlawful use is suspected; 
  • continued operation would breach applicable law; 
  • EFSTA suspends the underlying service. 

10. Intellectual Property 

All intellectual property rights relating to EFSTA software, cloud services, fiscal technology and related documentation remain the property of EFSTA or its licensors. 

The Customer receives only a limited right to use the service during the subscription period. 

11. Warranty Disclaimer 

Except as expressly stated in the eviivo Subscription agreement, the fiscal service is provided on an “as available” basis. 

Neither eviivo nor EFSTA warrants that the service will be uninterrupted, error-free or suitable for every business purpose. 

12. Limitation of Liability 

To the maximum extent permitted by law: 

  • neither eviivo nor EFSTA shall be liable for indirect or consequential losses; 
  • neither party shall be liable for loss of profits, business interruption or loss of data arising from use of the fiscal service; 
  • the aggregate liability of eviivo relating specifically to the EFSTA Cloud Fiscal Service shall not exceed the fees paid by the Customer for that service during the twelve (12) months preceding the event giving rise to the claim. 

Nothing in these terms excludes liability that cannot legally be excluded. 

13. Regulatory Changes 

Fiscal legislation may change from time to time. 

eviivo and EFSTA may modify the service where reasonably necessary to maintain legal compliance. 

The Customer agrees to install software updates provided for regulatory compliance. 

14. Termination 

Termination of the EFSTA Cloud Fiscal Service does not automatically terminate the eviivo Suite subscription. 

Following termination, fiscal data may remain retained for the period required by applicable law. 

The Customer remains responsible for complying with all statutory record-retention obligations. 

15. Governing Terms 

In the event of any inconsistency between these terms and eviivo’s General Terms, these provisions apply only in respect of the EFSTA Cloud Fiscal Service. 

These terms shall be governed by the same governing law and jurisdiction as the eviivo Suite Subscription Agreement. 

ADDENDUM 

NF525 and Fiscal Compliance 

The Customer acknowledges that the EFSTA service supports fiscal compliance requirements (including NF525 where applicable). The Customer remains solely responsible for ensuring that the software configuration, business processes and use of the service comply with applicable French tax legislation. 

Electronic Invoicing 

The EFSTA Cloud Fiscal Service is separate from any electronic invoicing or PDP services. Unless expressly included in the Customer’s subscription, the Customer remains responsible for selecting and maintaining any required electronic invoicing platform and for complying with applicable electronic invoicing obligations.
